1. Who we are and what this policy covers

Tropical Torque ("Tropical Torque", "we", "us") runs tropicaltorque.com, the Tropical Torque online store, and the Dream Car Giveaway sweepstakes. We are based in Lehigh Acres, Florida. You can reach us at torquetropical@gmail.com or (239) 823-2376.

This policy explains what personal information we collect when you visit our site, buy a wallpaper pack or Torque Club membership, enter a giveaway by mail, message us, or follow us on social media, and what we do with it. By using our site, buying from us, entering a giveaway or contacting us, you consent to everything described in this policy and agree to our Official Rules and Terms of Service. If you do not agree, do not use the site and do not enter.

2. Information we collect

Information you give us. When you buy something, we collect your name, email address, phone number and billing address, and a record of what you bought. When you enter a giveaway by mail, we collect what you write on the card: your name, street address, age, email address and phone number. If you create an account, message us, reply to a text or email, or tag us on social media, we keep that too.

Winner verification. If you are drawn as a potential winner, we will ask for a copy of a government-issued photo ID, your date of birth, a signed affidavit of eligibility and (where lawful) a liability and publicity release, and the tax forms needed to report the prize, such as an IRS Form W-9. If you take the vehicle, we also collect the details needed to transfer the title and arrange pickup.

Payment information. Payments are handled by our payment processor through our store platform, Shopify. We see the last four digits of your card, the card type and the billing name and address. We never see or store your full card number.

Information collected automatically. When you visit our site, Shopify and our analytics tools record your IP address, device and browser type, the pages you view, the site that referred you, and how you interact with pages and emails. Some of this is collected through cookies and similar technologies, described in section 6.

Accuracy. You are responsible for the accuracy of what you give us. We rely on the name, address and contact details you provide to record entries and to reach a winner. Entries made with false, incomplete or someone else's details are void, and we are not responsible if we cannot reach you because your details were wrong.

3. How we use your information

We use the information above to:

• Process your order, deliver your wallpaper download, and send your order confirmation and entry numbers.
• Record your giveaway entries, whether purchased or mailed in, and run the drawing.
• Contact the potential winner, verify their eligibility, and award the prize.
• Announce the winner. As set out in the Official Rules, we may publish the winner's name, likeness, hometown and statements about the giveaway, except where prohibited by law.
• Record and publish the live drawing, which may include the name on the winning slip being read aloud, and keep that recording as proof the draw was run as described.
• Send you service messages about your order, your entries, the live draw and changes to the rules.
• Send you marketing emails and texts about Tropical Torque giveaways, if you have agreed to receive them.
• Detect and prevent fraud, duplicate accounts, automated entries and other abuse of the giveaway.
• Enforce our Official Rules, Terms of Service and this policy, investigate suspected violations, and establish, exercise or defend legal claims.
• Keep the records that sweepstakes, tax and consumer-protection laws require, and respond to lawful requests from authorities.
• Answer your questions and respond to requests you make under this policy.

We do not use your information for automated decisions that have legal effects on you. The winner is chosen by a random physical draw, not by any profile of you.

4. Emails and text messages

When you buy from us or enter a giveaway, we send you transactional emails: order confirmations, download links, entry numbers, winner notifications and rule changes. You cannot opt out of these while you have an active order or entry.

If you tick the marketing box at checkout, or text a keyword to our number, you agree to receive recurring marketing emails and automated text messages from Tropical Torque about giveaways, wallpaper drops and Torque Club. Consent to texts is not a condition of buying anything or of entering. Message frequency varies. Message and data rates may apply.

To stop texts, reply STOP to any message. For help, reply HELP or email torquetropical@gmail.com. To stop marketing emails, use the unsubscribe link at the bottom of any email. Opting out does not affect entries you have already received.

5. Who we share information with

We do not sell your personal information, and we do not share it with other companies for their own marketing. We share it only with:

• Shopify, which hosts our store and checkout and processes orders on our behalf. Shopify's handling of your data is described in the Shopify Privacy Policy.
• Payment processors, to take your payment and screen for fraud.
• Service providers that work for us: the app that delivers your wallpaper download, our email and text-messaging providers, analytics tools, and the accountants and lawyers who advise us. They may use your information only to provide their service to us.
• Tax and government authorities, for example when we report the value of the prize to the IRS, and law enforcement or courts when the law requires it or when we need to protect our rights, our customers or the public.
• The public, limited to the winner's name, likeness and hometown as described in the Official Rules, and the winner's name on request as the rules require.
• A successor, if Tropical Torque is sold or merged, in which case your information transfers with the business under this policy.

Social platforms such as Instagram, TikTok and YouTube are not our service providers. What you post or send there is governed by their policies.

6. Cookies and tracking

Our site uses cookies and similar technologies set by Shopify and by the analytics and advertising tools we use. They fall into three groups:

• Necessary cookies keep your cart, run checkout, and protect the site from abuse. The site does not work without them.
• Analytics cookies tell us which pages people visit and how they found us, so we can improve the site.
• Advertising cookies, such as the Meta Pixel or Google tags, let us measure our ads and show you ads for Tropical Torque on other sites.

You can block or delete cookies in your browser settings; the site may not work fully without the necessary ones. A list of the cookies Shopify sets is in the Shopify Cookie Policy. Our site does not respond to browser "Do Not Track" signals, but it does honor opt-out preference signals where state law requires.

7. How long we keep information

We keep order and entry records for the length of the giveaway and for as long afterward as tax, sweepstakes and consumer-protection laws require, which can be several years. Winner verification documents are kept only as long as needed to award the prize and meet those legal requirements, then deleted. Marketing contact details are kept until you unsubscribe. Mail-in cards are kept until the drawing is complete and any disputes are resolved, then destroyed.

8. Security

Our site and checkout run over encrypted connections, and payment details are handled by PCI-compliant processors rather than by us. Winner documents are stored in access-controlled accounts and shared only with the people who need them to award the prize. No system is perfectly secure, so we cannot promise that your information will never be accessed without authorization. If a breach affects you, we will notify you as the law requires.

9. Your choices and privacy rights

You can unsubscribe from marketing emails at any time with the link in any email, and stop texts by replying STOP. You can also email torquetropical@gmail.com to ask us to:

• Tell you what personal information we hold about you and how we use it.
• Correct information that is wrong.
• Delete your information, unless we must keep it for an order, an active entry, or a legal requirement.
• Send you a copy of the information you gave us.

We will confirm your identity before acting, usually by matching the email address on your order or entry, and we will respond within the time the law allows, normally 45 days. We may decline a request where the law permits, for example when we must keep a record for an order, an active giveaway, or tax reporting, and we may charge a reasonable fee for requests that are repetitive or excessive where the law allows. We will not treat you differently for exercising these rights.

California residents have these rights under the California Consumer Privacy Act, plus the right to know the categories of information we collect and share and the right to opt out of the sale or sharing of personal information. We do not sell personal information and do not share it for cross-context behavioral advertising, other than through the advertising cookies described in section 6, which you can block in your browser. You may designate an authorized agent to make a request for you; we will ask the agent for proof of your written permission.

Residents of other states with consumer privacy laws, including Virginia, Colorado, Connecticut, Texas and Oregon, have similar rights and can use the same email address to exercise them. If we deny a request, you can appeal by replying to our response, and we will explain the outcome within the time your state's law requires.

10. Age requirement

Our site, store and giveaways are for people who are 18 or older, or the age of majority where they live. We do not knowingly collect personal information from anyone under 18. If you believe someone under 18 has given us information, email torquetropical@gmail.com and we will delete it and void any entries.

11. Other sites and social platforms

Our site links to Instagram, TikTok, YouTube and other services we do not control. Their privacy practices are their own; read their policies before you share information there. Our giveaways are not sponsored, endorsed or administered by any of those platforms.

12. Changes to this policy

We may change this policy at any time. Changes take effect when we post them here with a new date at the top, and your continued use of the site or participation in a giveaway after that date is your acceptance of the changed policy. If a change materially affects how we use information you have already given us, we will email you or post a notice on the site before it takes effect.

13. Content you post about us

If you tag Tropical Torque, use our hashtags, reply to our posts, or send us photos, videos, reviews or messages about a giveaway or a wallpaper, you give Tropical Torque a free, worldwide, non-exclusive, permanent license to use, copy, edit, publish and display that content, with your name or handle, to promote our giveaways in any media, without payment to you. Only send us content you have the right to share. If you want us to stop using a specific post, email torquetropical@gmail.com; we will remove it from the channels we control within a reasonable time, but we cannot recall material that has already been shared, printed or reposted by others.

14. Our responsibility and its limits

We take reasonable steps to protect your information, but no website, email system or payment network is completely secure, and we cannot guarantee that your information will never be lost, intercepted or accessed without authorization. To the fullest extent permitted by law, Tropical Torque is not liable for:

• Unauthorized access, loss or disclosure caused by events outside our reasonable control, including attacks on Shopify, our payment processors or our other service providers, or on your own device or accounts.
• The privacy practices or security of any third-party site, app or social platform, including those we link to.
• Losses caused by anyone impersonating Tropical Torque. We contact you only from the email address, phone number and verified social accounts listed in the Official Rules, and we never ask a winner to pay anything.
• Any failure to reach you, or any missed entry, notification or prize, that results from inaccurate or out-of-date details you gave us, a full mailbox, spam filtering, or a blocked phone number.

Where the law does not allow a liability to be excluded, our total liability to you for any claim relating to this policy or your personal information is limited to the amount you paid us in the twelve months before the claim arose. Nothing in this policy limits rights that cannot be limited under the law of your state.

15. Where we operate and which law applies

Tropical Torque operates from Florida, and your information is stored and processed in the United States. Our site, store and giveaways are intended for residents of the United States; if you visit from elsewhere, you do so on your own initiative and consent to your information being transferred to and processed in the United States under U.S. law. We do not offer the rights provided by the laws of the European Union, the United Kingdom or other countries, and we do not knowingly collect information from residents of those places.

This policy is governed by the laws of the State of Florida without regard to its conflict-of-law rules. Any dispute about this policy or about our handling of your information is subject to the dispute-resolution, governing-law and venue terms in our Terms of Service and, for giveaway entrants, the Official Rules, including any requirement to resolve claims individually rather than as part of a class.
